i got a ticket as a backseat passenger in New york?
ok me and my friends just pulled out of a parking lot and as soon as we hit the curb a cop pulls us over my friend had his seat belt on and still got a ticket i was in the back without one and still got a ticket is that fair? because it does make sense never once until today did i get a ticket for not having my seat belt on in the back and ideas? the law shows this

Seat belts must be worn, as follows:
All passengers in the front seat of a motor vehicle must wear a seat belt [Section 1229-c (2) and (3), NYS Vehicle & Traffic Law].
All children under the age of sixteen (16) must wear a seat belt in the back seat NYS Vehicle & Traffic Law]. Children from birth through age six are required to ride in an appropriate child restraint system.
All children under the age of 16 are required to be buckled up when traveling in recreation vehicles, mobile homes and campers if they are equipped with seat belts.

Every occupant, regardless of age or seating position, of a motor vehicle being operated by the holder of a Class-DJ Learner Permit, a Limited Class-DJ Driver License must be restrained by a safety device.

Well if that's a current statute, send a copy of it to the courthouse and a copy of your drivers license, or better yet, do it in person. I hope the law hasn't changed, but you should always buckle up anyways. It could save your life if you were to ever get in an accident.

That reads close to the same as it is here in Arkansas. Since you are over 16, and you were in the back seat, then you shouldn't have gotten a ticket. I'd take it to court, along with a copy of the statute. ( You may want to try to contact a City Attorney/ Prosecutor, and they may dismiss it for you without court.) Good Luck.*********************I'd like to add, yes, the law may have changed in your state so checking with the city prosecutor will eliviate this confusion.

it is now national law that all passengers must wear a seat belt regardless of age or where they are seated wit the exception of certain vehicles like public busses. were there only two of you in the car? If your friend was driving and had his seat belt he still got ticketed because you didn't have yours on. You got a ticket for being an adult without one. The driver is responsible for every poassenger. All passengers over the age 16 are responsible for themselves. Haven't you heard of the "click it or ticket" campaign. I think you totally deserved the ticket. wear your seatbelt, don't risk your life or anyone elses. its not worth dieing over. pay your fine and learn a lesson
